I am making this declaration ("Release") with the understanding that it will be relied upon to confirm my participation in the Axis Rewards (the "Rewards Program") being offered by Axis Auto Finance ("Axis", "we", "us", "our").

I declare that I have read, understand, and agree to all of the Rewards Program Terms and Conditions as well as Privacy and other Policies (the "Terms") which are available at https://www.axisautofinance.com/DealerRewardsTerms, that all of the information below is true and that I have committed no fraud or deception in participating in the Rewards Program.

I acknowledge that eligibility for rewards under the Rewards Program commences as of the calendar month of my registration for the Rewards Program.

I acknowledge that rewards will be paid to the business/F&I manager indicated on the lender portal (DealerTrack or otherwise) at the time of booking/funding of each deal and are subject to continuous participation of the dealership booking said deal in the Rewards Program. In consideration of the receipt of the Axis Auto Finance Reward Canada Prepaid Mastercard® (the "Card"), I agree as follows:

1. To release, discharge and hold harmless Axis, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Rewards Program (the "Released Parties") from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a Card, suit, debt, covenant, contract, including legal fees and expenses whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third-party contractor or supplier to Axis or used in connection with any aspect of the Rewards Program to perform or deliver services, any act of God or any other event beyond Axis' control, any dissatisfaction of any kind with any aspect of the Rewards Program or the Card, liability for physical injury, death, or property damage which I, my heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of participation in the Rewards Program and/or in connection with the acceptance and/or exercise of the Card.
2. To indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance with the Terms, exercise of the Card, and participation in the Rewards Program.
3. To indemnify the Released Parties from any income taxes, employment insurance premiums, Canada Pension Plan contributions, health tax levy liabilities, penalties, charges, interest and costs assessed or imposed against the Released Parties arising from or in respect of the payment by the Released Parties under the Rewards Program.
4. To return upon demand to Axis, or its agents, representatives or marketing partners, any Card that has been or may be awarded to me if any statement made by me in this Release is false or if I have failed to comply with any of the Terms, all as determined in the sole discretion of Axis.
